These General Terms and Conditions are written in plain language. No small print or unclear constructions. Of course we cannot describe everything in detail. Ultimately it's about trust and sincerity. You can expect us to honor agreements and we can expect the same from you. In addition to the specific agreements about your treatment, these general agreements apply. These General Terms and Conditions apply to the conclusion and implementation of the treatment agreement concluded between you and the healthcare provider.
1. Definitions
• FueGenix Hair Clinic: The Healthcare Provider.
• Healthcare provider: The organization that has medical procedures performed by the Healthcare Provider.
• Healthcare: The practitioner who carries out a (cosmetic) treatment on the client.
• Client: Natural person who has indicated that he or she wishes a (cosmetic) treatment carried out by the Healthcare Provider.
• Therapy: Medical procedure (of a cosmetic nature) for which a Treatment Agreement has been drawn up.
• Treatment agreement (Informed Consent): Agreement in which the agreements regarding the medical and/or cosmetic procedure are recorded. It also points out the risks associated with the medical and/or cosmetic procedure and the client's own duty of care.
• Prices: The treatment amounts offered or the amounts communicated in another way.
• Complaint: An objection submitted by or on behalf of the client to the Care Provider or Healthcare Provider against the method of care or service provided.
Complaints Procedure: A procedure drawn up by the Healthcare Provider that the client can use to assess his/her Complaint.

2. What can the Client expect from the Healthcare Provider and Healthcare Provider?

2.1 Information provision

2.1.1 Extensive and honest information
The Healthcare Provider and Healthcare Provider will inform the Client in detail about the options that can resolve the Client's discomfort. The Client will provide the Care Provider with all relevant information, so that the Care Provider gets a clear picture of the Client's wishes and expectations. The Care Provider will clearly explain the Treatment(s) to the Client and point out the limitations, the risks, the client's duty of care and the progress of the recovery.

2.1.2 Costs of the treatment
If applicable, you will receive a treatment agreement before the start of the treatment. This includes the agreed treatment price. You will receive a quote on the day of your consultation. When booking a treatment date, we ask you to make a down payment. You must pay this within 1 week after receiving the emails. If we do not receive the deposit on time, there is a chance that your treatment date will be canceled. You can pay the remaining amount no later than 2 weeks before the day of your treatment.

2.1.3 VAT
If the Treatment does not result from 'human health care', the treatment price will be taxed with VAT. When the Care Provider makes the diagnosis, it will be determined whether the Treatment should be taxed with VAT.

2.1.4 Treatment information
The Healthcare Provider will ensure that the Client is provided with extensive and understandable information about the medical procedure. The Client receives this information during and after the first consultation.

2.1.5 Website
The Client can also obtain extensive information about the desired or agreed treatment on the Healthcare Provider's website. The FueGenix Hair Clinic website has been compiled with all care. No rights can be derived from it.

2.2 Skilled Healthcare Providers

2.2.1 Quality of the Healthcare Provider
The Care Provider guarantees that the Client is treated by an experienced Care Provider who has an impeccable track record and is allowed to carry out his work in accordance with the law. The Care Provider will only carry out Treatments in which he is authorized, trained and experienced.

2.2.2 Accessibility of the Healthcare Provider
The Care Provider is available to the Client during the entire treatment process or, in his absence, has transferred care for observation.

2.2.3 Indication
The Care Provider sets the indication or has appointed an assistant, who carries out the indication under the supervision of the Care Provider. The Healthcare Provider is ultimately responsible for drawing up the treatment plan.

2.2.4 Pre-treatment examination
Part of admission for Treatment is an investigation into the Client's medical past. In some cases the client must complete a so-called anamnesis form. The Care Provider uses this information to investigate whether there are increased risks associated with the desired Treatment. If these are unacceptable, the Healthcare Provider will not carry out the treatment.

2.3 Equipment and tools

2.3.1 Equipment
The Healthcare Provider guarantees that all equipment used is suitable. This means that the instruments are clean (sterile if applicable) and that the equipment is safe in accordance with the existing guidelines.

2.3.2 Tools
In its work, the Care Provider uses equipment and other medical devices that are registered and whose origin can be traced.

2.4 Aftercare

2.4.1 Information
The Client receives detailed written instructions for the period after the Treatment and (oral) personal instructions from the Care Provider.

2.4.2 Accessibility
After the treatment, the Client can continue to contact the Care Provider if the Client feels uncomfortable or has any questions. The Care Provider can be reached directly on working days from 09.00 a.m. to 17.00 p.m. via 06-83331555 and outside these times for emergencies directly via the emergency telephone.

2.5 File

2.5.1 File creation and retention period
The Healthcare Provider sets up a file regarding the Client's Treatment. To the extent necessary for proper assistance, the Healthcare Provider makes notes of the information about the Client's health, the procedures performed and includes other similar information in the file. Client data will be kept by the Healthcare Institution for 15 years. These can only be viewed by you and those involved with the Healthcare Provider.

2.5.2 File contents
The Healthcare Provider will record in the file, among other things, the special circumstances observed prior to the Treatment, any materials administered or used, the traceability of materials used, the medical devices used and the data during the Treatment. Notes are also taken during the consultations and photos of before and after the treatment are in the file.

2.5.3 Inspection of file
At the Client's request, the Care Provider will provide the Client with access to and/or a free copy of the file as soon as possible. If a third party wishes to inspect the file, the Healthcare Provider will only provide this after written permission from the Client.

2.5.4 File retention period
Unless earlier destruction has been requested in writing, the Healthcare Provider will keep the Client File for 15 years from the moment the treatment plan has been fully completed.

2.6 Liability of Healthcare Provider

2.6.1 The liability of the Healthcare Provider
The liability of the Care Provider, to the extent that it is covered by its liability insurance, is limited to the amount of the payment made by the insurer.
2.6.2 If in any case the insurer does not pay out or damage is not covered by the insurance, the liability of the contractor is limited to the amount agreed with the client, or at least that part of the assignment to which the liability relates.
2.6.3 The contractor is never liable for consequential damage.

3. What can the Healthcare Provider expect from the Client?

3.1.1 Provide information about medical history
If requested by the Healthcare Provider, the Client will provide all information about his/her medical history and medication use. The Client will cooperate in supplying/requesting medical data known to other specialists where the Client is (or has been) receiving treatment.

3.2 Expectations, complications and results

3.2.1 Expectations
The client has realized that cosmetic treatments lead to improvements but never to perfection. The Client has clearly communicated his expectations and taken the Healthcare Provider's answers into account before entering into this Treatment Agreement.

3.2.2 Complications
The Client has realized that infections and complications can occur during and after the Treatment. Before entering into the Treatment Agreement, the Client has assessed whether these risks sufficiently outweigh the purpose of the Treatment.

3.2.3. Result
During the information phase, the Care Provider has clearly indicated what the Client can expect from the intended Treatment. The Client realizes that the Care Provider cannot guarantee results and must only make maximum efforts.

3.2.4 Shortcomings
The Client has the right to address the Care Provider about expectations and complications. If the Care Provider has failed to do so, the Care Provider must clearly inform the Client of this.

3.3. Payment

3.3.1 Payments
Client will make payments for the Treatment as agreed. If for any reason the Client cannot pay the agreed amounts on time, the Client will immediately inform the Healthcare Provider.

3.3.2 Failure to pay
In the event of late payment, the Client is in default and all payment obligations become immediately due and payable. If payment is not made on time, the Client is liable for damages to the Healthcare Provider.

3.3.3 Interest and collection costs
In the event of late payment, the Client owes statutory interest on the outstanding amount from the date of default in accordance with Article 6:119a of the Dutch Civil Code. In addition, extrajudicial collection costs will be charged to the Client in accordance with the collection rate of the Royal Professional Organization of Bailiffs, without prejudice to the Healthcare Provider's right to full compensation.

3.3.4 Discounts
Discounts provided by the healthcare provider to a client are completely personal and not transferable to another person.

3.4 Default and Cancellation

3.4.1. Absence
If all surgical procedures are missed, the full amount will be charged if the written treatment agreement is not adhered to. 

3.4.2 Cancellation
Surgical procedures can be canceled more than 30 days in advance. The deposit is non-refundable once it has been paid.

If surgical procedures are canceled within 30 days (not counting the day of cancellation and the day of the procedure), 50% of the total amount will be charged. If surgical procedures are canceled within 14 days (not counting the day of the procedure), 100% will be charged. Unless there is proof to the contrary, the healthcare provider's administration applies as complete proof that such an agreement had been made.

3.4.3 Cancellation or suspension of treatment agreement
Cancellation or suspension of the treatment agreement is possible if the client behaves improperly or discourteously towards the care provider or its employees or towards fellow clients.

3.4.4 Failure to attend the consultation
If the consultation is missed without notice of cancellation <24 hours in advance, the amount paid of €1000 will not be refunded. The Client can schedule a new consultation for which payment must be made again.

3.5 Dissatisfaction

3.5.1 Complaints procedure
If the Client is not satisfied with the way in which the Client has been approached, about the treatment or is of the opinion that he/she has not been properly informed by the Healthcare Provider, the Client will use the Healthcare Provider's Complaints Procedure by submitting a complaint via info@fuegenix. NL. The Client has the right to use other avenues regarding his dissatisfaction after the entire Complaints Procedure has been completed.

4. General provisions

4.1 Secrecy

The Healthcare Institution does not provide data to third parties without the Client's consent. All employees of the Healthcare Institution have signed a confidentiality statement with a penalty clause.

4.2 Privacy (regulations)

The Healthcare Provider applies privacy regulations, which are made available to the Client upon request.

4.3. Changes to the General Terms and Conditions.

The General Terms and Conditions and the information stated on the website can be changed by the healthcare provider at any time.
